DRIVING OFFENCES

The firm has been defending driving offences, including drunk driving offences, for over 60 years and has the expertise to provide you with the best possible defence for offences such as impaired driving, over 80, dangerous driving and careless driving.

Impaired driving is when a person’s ability to drive their car (or other vehicle) is impaired by alcohol or drugs. Over 80 is when a person’s blood alcohol content is over the legal limit, which is 0.08 in Ontario.Dangerous driving occurs where the manner of a person’s driving is dangerous to the public. Careless driving is a charge under the Highway Traffic Act where the person drives without due care and attention or without the due consideration to other persons on the road that a driver of ordinary care would have used in the circumstances.

There are minimum sentences associated with these charges even for persons who have no prior criminal record. As a result, a conviction in relation to these charges can have serious consequences, including a criminal conviction and the loss of one’s licence for a year or more. The defence in these cases is often technical and requires a lawyer with a broad knowledge of the law and the ability to extract the details of one’s defence. The lawyers at Cooper, Sandler, Shime & Schwartzentruber LLP are experienced in dealing with driving offences and can assist you in these matters.
